This agreement is subject to the following conditions:

·         Payment of fees:   Payment of  one half of the total stud fee, which shall serve as a booking fee and is Non-Refundable, along with a signed copy of this contract must be received prior to shipment of transported semen or upon arrival of mare at farm.

·         The balance of the stud fee is due when the mare is declared in foal.  It is the mare owner's responsibility to inform Glen Oaks Farm when the mare is declared in foal.  Mare Owner agrees to have the mare pregnancy checked by a licensed veterinarian within 60 days after the last breeding date.  Live foal guarantee will become null and void if the mare is not checked within 60 days of the last breeding date and Glen Oaks Farms not notified of the results.

·         A Finance Charge, computed at a periodic rate of 1.5% per month (18% annual percentage rate), is applied to past due accounts over 30 days.  Owner is liable for all legal and collection fees.

·         Foal registration papers and breeding certificates will not be furnished until the Mare Owner’s account is in good standing.

Shipping:     It is the Mare Owner’s responsibility to call in advance of the planned breeding date to check the collection and shipping schedule at Glen Oaks Farms.  Normal collection days are Monday, Wednesday, Friday, and Saturday morning.  Your request for semen must be telephoned or faxed no later than 10:00 am CST on your scheduled collection day to meet shipping deadlines.

·         The shipping container (Equitainer) will be furnished by Glen Oaks Farms.  All shipping charges will be paid by the mare owner and must be paid prior to the shipment of semen.  The mare owner agrees to return the Equitainer to Glen Oaks Farms by Next Day return shipping service.  If the Equitainer is not returned promptly, there will be no further shipment of semen.  Failure to return the Equitainer within 10 days will result in a $100 penalty plus the cost of replacing the container.

·         Each shipment will contain 1 or 2 doses at the discretion of the stallion manager.

·         The fee for semen shipments, including collection and shipping, is $150 for next day service and $175 for same day air service.

·         Glen Oaks Farms only assumes responsibility to ship semen in a viable condition at the time of delivery to the mare owner’s farm or other designated location.  Glen Oaks Farms assumes no responsibility for the loss of semen viability or associated expense due to any delay in shipment, delay in airline schedules, or delay in courier services beyond our control.  A licensed veterinarian or an authorized technician must administer the semen on the day of delivery or all live foal guarantees and return privileges shall be null and void.

·         Live Foal Guarantee:  Should the mare fail to produce a foal which stands and nurses, the mare owner shall be entitled to rebreed the mare or substitute a mare.  There will be no additional breeding fee for a rebreed, but expenses shall apply.  Failure to notify Glen Oaks Farms in a timely manner shall result in the loss of the live foal guarantee and return privileges.  This clause is also binding in the case of abortion.

·         The mare owner fully understands, authorizes, and assumes the special risk inherent in breeding with the use of transported semen.  Mare owner also understands the risk of failure due to many variables and shall hold Glen Oaks Farms and the stallion owner harmless for any losses suffered due to an unsuccessful attempt at conception.

·         Womack Stables - Glen Oaks Farms, LLC. or Rick Womack shall not be liable for the death, sickness and/or accident, including consequential damages caused to the mare and/or foal, and mare owner agrees to hold Womack Stables-Glen Oaks Farms, LLC or any person associated with the same, harmless for any and all damages associated herewith.

·         Coggins:     State law requires that all equines transported in the state of Tennessee have a one-year negative coggins test.  It is the mare owner’s responsibility to provide Glen Oaks Farms with a copy of the coggins test at the time of leaving the mare at the farm.  If one is not provided then one will be pulled at the owner’s expense.

·         Vaccinations:     Glen Oaks Farms requires that all mares be current on vaccinations and deworming, including but not limited to West Nile, EEE, and strangles.
